INFORMATION REPORT ABOUT THE PROTECTION OF PERSONAL DATA IN CONFORMITY WITH ART. 13 OF THE LEGISLATIVE DECREE NR. 196, DATED JUNE 30, 2003

In compliance with the regulations provided for by Art. 13 of the Legislative Decree dated June 30, 2003 and its effects, the Company “EVIDENCE” in its qualification of holder,  informs all those concerned that give their data on the form of the website about the purposes and methods of the treatment of the personal data collected, the area where they will be communicated and spread and also the nature of their release.

The collected data of all those concerned will be treated and used only for operating the stages foregoing the drawing up of a contract, in the total respect of the principles of correctness and the provisions of the law.

The data will be treated with electronic and data processing instruments by persons who work in the Company and are suitably in charge of this. The data will be kept in computerized files and the minimum measures provided for by the legislator in terms of safety are guaranteed.

If the negotiations carried out during the pre-agreement stage do not lead to a positive result, your data will be kept and stored for any possible future use and agreements and/or enquiries. They will not be kept, however, for longer than one year.

The data of those concerned will not be communicated, sold or exchanged with third parties, nor will they be divulged.

Those concerned will be entitled to vindicate their rights as provided for by Art. 7, 8, 9 and 10 of the Legislative Decree Nr. 196 dated June 30, 2003 by applying to the holder of the data treatment. In particular, and according to Art. 7, they have the right to request and obtain the confirmation of the existence of the personal data that concern themselves, even if these have not yet been registered and also obtain their communication in a understandable form. Those concerned, moreover, have the right to obtain the information regarding:

a) the origin of personal data;

b) the purposes and methods of the data treatment;

c) the logic enforced in the case of data treatment carried out with the help of electronic instruments;

d) the personal particulars of the holder, the persons in charge and the appointed representative, in conformity with Art. 5, paragraph 2;

e) the person or categories of persons to whom personal data may be communicated or who may get to know them as appointed representatives within the State territory, persons in charge or appointed persons.

Those concerned, moreover, have the right to obtain the following:

a) the updating, the amendment or, if there is an interest, the integration of the data;

b) the cancellation, the transformation into an anonymous form or the stoppage of the data that are being treated under infringement of the law, including those data the preservation of which is not necessary in relation to the purposes for which they were collected or later treated;

c) the confirmation that the operations under a) and b) have been made known, also for their content, to those to whom data have been communicated or divulged, except for the case when such fulfilment turns out to be impossible or however involves the utilization of means clearly disproportioned to the right safeguarded.

Those concerned have the right to oppose, totally or partially, in the following cases:

a) for legitimate reasons regarding the treatment of their own personal data, provided these data are pertaining to the purpose of their collection;

b) due to the treatment of their personal data used for sending advertising or sale material or carrying out a market research or a commercial communication.

In the case of a contract termination, data will be kept within the terms provided for by the law in relation to the accounting and tax regulations in force. 

In compliance with Art. 24 of the Legislative Decree Nr. 196 / 2003, it is necessary to obtain the consent to the treatment of the above mentioned data, as these have been collected on request of those concerned for the negotiations for a possible stipulation of the agreement.
